In 1987, a gentleman asked me to help a political campaign. After the task had been successfully done, I worked as a congressional staff at a congressional office to serve the constituency and in the Legislative Yuan as a political speechwriter.

I am compiling some original 400+ pieces of articles/interpellations drafted by me as a speechwriter during a big transformation of the political area - 1987 to 1990. They were listed in different categories. 最近開始整理1988 至1990 的 400 多篇立法院質詢草稿. 分成分兩類書面質詢 : 總質詢/普通質詢, 和緊急質詢.

Can one be neutral on a moving train? The posted contents constrained by the specific timeframe, was based on the job descriptions. I refrained parts of my own politico-economic stance and philosophy during that turbulent time with an effort to extend timing ideas accorded with the politico-economic situations.  在極有限度的表達空間, 筆者儘量維持僱用者的黨, 政立場之時, 並擴充當時政經情境應有的理念.

The first one was an original draft that functioned as a general type of interpellation for a congressperson to the leader of the Executive Yuan. The second category is the urgent interpellation.

The tone of the most writing was "conservative" by nature, due to certain political constraints to write about the socio-politico-economic issues during that chaotic time when Martial Law was just lifted.

主題“拓展憲政新境界, 開創經濟新里程, 建構社會新秩序,” 的三新改革, 要求院長落實 “國家安全, 社會安定, 人民安康” 的三安施政方針.

行憲近四十年, 全國上下胼手胝足, 生聚教訓, 為建國的千秋大業, 勤奮不懈. 終在自由台灣締造了史無前例的繁榮. 此番在山儲雲出山為雨的蘊藉, 凝成沛然莫之能禦的力量. 在這變動不居的流程中, 顯示出我們經濟社會結構的大轉變. 一方面展現出動態社會, 鳶飛魚躍的旺盛活力, 另一方面也產生了急遽變遷下, 社會意識形態與行為模式嚴重脫序的棘手現象. 傳統視為理所當然的敏感禁忌與 刻版意識形態, 受到長久以來 ”特定情境” 與僵化製度的制約, 累積了功能調適的障礙.

面對瞬息萬變的工商社會之衝擊, 資訊革命無遠佛屆的洗禮與時代潮流的激盪, 已顯現出社會中各種角色, 規範, 價值, 制度的混淆和脫節的衝突現象, 隱藏認同和適應的危機. 這就是為什麼我們一方面努力建構勞委會, 環保署改制, 國安法制定, 解除戒嚴, 開放報禁, 書禁, 師專改制, 藝術中心次第成立, 廢除不良稅制, 減低關稅, 拼命累積外匯, 都會捷運規劃修建等重大因應情勢措施之時, 我們同樣也脫離不了脫胎換骨天蠶巨變的認同與失調. 如大家樂,飆車, 熱錢滾入, 股市炒作, 自力救濟街頭運動等, 對公信力公權力之挑戰, 要求國會全面改選, 地方自治法制化, 市長民選, 大陸漁船扣關, 返鄉探親, 海峽兩岸另類接觸及一連串解禁的要求等等, 涵蓋政治, 經濟, 社會等各層面冰凍三尺的新舊問題, 卻在剎那間解凍, 確實有令人措手不及之感. 只有面對這些具有連鎖反應的舊惡新恙, 任何以頭痛醫頭和頭痛醫腳的偏方秘方, 皆不是正本清源除病斷根之良方. 唯有以整體的觀點, 探討問題的脈絡本末, 對症下藥, 方得有效. 由於牽涉的層面太廣泛, 謹就政治經濟社會三大面向中, 歸納出最迫切也是最重要的改革項目, 就教於院長, 如何落實 “國家安全, 社會安定, 人民安康”的施政方針.

壹. 拓展憲政新境界

一. 充實中央民代改選 - 自行憲以來, 中央第一屆民意代表就職至今, 未能依其辦理全國選舉. 而依照臨時條款時條款, 繼續行使職權, 時至今日, 已產生日漸凋零的事實. 其合法性與適當性, 歷經時局變遷, 以成為當前國會未臻健全的問題之源. 而結構未健, 功能未彰的國會如何能落實現政黨政治, 民意政治, 與責任政治的目標呢? 目前要求全面改選的呼聲, 此起彼落. 然所涉及之法律, 法統, 與現任資深民代如何安撫的三角問題, 經政府廣泛徵詢各方意見, 審慎研究後, 是否也該有了定案? 此項改革方案之破切, 涉及層面又深廣, 因此, 鑒於民眾這裡漸趨不耐, 故事務期以合理, 合法, 公平的原則, 早日製定眾望所歸之措施. 否則在議場內類似 “朱金對罵”: 街頭上抗議衝突事件的紛爭, 將永無止境.

二. 快速自訂具有前瞻性, 整體性之大陸政策 - 目前台灣與大陸的關係係為一分裂國家的兩個政治實體, 各自宣稱對對方的管轄領土, 具有主權. 既是如此, 為什麼我們還要繼續往昔的 ”政治心狹心症”畫地自限. 不論是舊三不, 還是新三不, 都是鴕鳥式的不太負責任心態的產物. 我們一以全民利益為出發點, 政治歸政治, 經濟歸經濟, 文化歸文化, 在維持高度自主性向主動正面出擊. 以我們的政治民主, 經濟繁榮, 教育普及, 文化建署等等等令人刮目相看的成就, 作為政治反攻的必勝籌碼. 不恃敵之不來, 恃吾有以擊之. 在開放返鄉探親後, 也應研領一套整體性, 前瞻性的體育, 學術, 經貿交流規範, 以開闊胸襟, 自反而縮雖千萬人吾往矣的氣魄, 來實踐 “落實本土, 放眼世界” 的原則. 千萬不要落人 “不點不亮”的衙門作風的把柄.

三. 化解國家認同的困境 - 台灣政治社會結構的敏感複雜, 意識形態的分歧程度, 因時空因素以達到世界無出其右的地步. 他麻雀雖小卻十臟俱全. 政治信念與社會現實的差距, 乃是正問題癥結所在. 東晉哀帝以降, 為減少南人, 北人之竿格不入, 連續多次實行土斷, 隔閡遂日減. 此便是先求和諧, 再談理想的應變成功的模式之一. 頗值三思. 反觀我們現在的 “吹台青”策略, 陷入裡外不是人的兩難困境. 台灣意識與中國意識, 就在”刻意的本土化”與 ”政治利益” 掛勾情況下, 觸動了久蜇人心 的千千結. 最近 ”台灣獨立” 的口號滿天價響, 催促得人心浮動. 如果我們不再加速地方自治法制化, 健全政黨政治的運作用, 人唯才的話, 煙能服人心, 止民怨?”

四. 調整中央及省,市地方組織體系, 並增設農業部, 勞工部, 貿易部, 與文化部, 以因應時勢變遷後, 國家社會擴展的整體要求.

貳. 開創經濟新里程 

一. 整頓內部經濟型態的缺失 - 我們仰賴貿易的海島型經濟型態, 實在不堪目前戲碼分亂的 “金錢遊戲”的蹂躪. 我們的社會更承擔不起另一次的國信十信 金融風暴. 現在國內市場資金浮濫, 服飾無適當出路. 熱錢滾入, 並尚在觀望. 投資工具不足, 資金轉向操作股票與大家樂. 社會大眾爭相競逐短期暴力, 與實質經濟成長有害無益. 眾所周知, 我們的股市是世界有名的畸形, 不但不健全, 易為人 炒作操縱勾結, 哄抬行情, 而且證券信用管理不當, 僵文難行, 法治古舊, 逐漸形成目前貨幣供給額居高不下, 隱藏物價上漲的危機,. 現在整個金融市場, 雜亂無章, 險象叢生, 財經當局也各秉著兵來將擋, 水來土掩的功夫, 東挖西補, 但求治標於一時, 誰也不敢擔當, 制定方案牛步化, 居心觀望, 焉能觀徹資本證券化, 證券大眾化的政策? 又三四十年來所製定的經濟管制規範, 早該列為古蹟文物, 又如何能適應當前快速變遷的工商社會? 到底要待何時才能製定修訂時間表, 引導我國經濟景氣走向真正的自由化國際化?制規範早該列為古蹟文木又如何能適應當前快速變遷的工商社會到底要帶何時才能製定修訂時間表的引導我們的經濟景氣走向真正的自由化, 國際化?

二. 擬定令與大陸轉口貿易政策政府 - 自解嚴後, 大批中共漁船到台灣沿海來活動, 暫且拋開政治可能因素不談, 目前在法律邊緣遊走的海峽兩岸轉口貿易, 根據中華經濟研究院統計顯示:



今年 (1987) 一至五月, 台灣產品經香港銷往大陸者已達美金四億三千萬, 比去年同期成長百分之五十三. 大陸經香港輸往台灣的貨物已達美金一億一千萬, 成長百分之八十. 此種超高成長, 背後又意味著什麼?

如此兜圈子賺大錢的潛在意義, 隱藏多少的問題呢? 目前開放大陸探親後, 海峽兩岸接觸必然頻煩熱絡起來. 雙方貿易機會, 也必然跟著成長. 目前就貿易量, 除香港外, 無人可比. 有人預估與大陸做生意, 如果沒有政治因素介入, 則市場佔有率可達百分之九, 一年約有四十億美元, 佔台灣總出口量百分之十. 這對資金或無出路的台灣企業家, 無一事項不可抗拒的誘惑. 因為這樣一來, 既可協助大陸現代化自由化民主化, 又可溝通感情互通有無,大賺其錢, 於公於私, 相得益彰, 何樂不為? 然而樂不可極,一旦我們與他們貿易金額居高, 遍 嚐甜頭之後, 可能要面對的, 不是經濟歸經濟的單純問題, 是經濟會流於政治談判的籌碼, 到時反會被中共誘敵深入, 以空間換取時間, 受制於中共. 諸如此類的有關中共之間的轉口貿易往來, 可能產生的問題, 如何在政治上劃定一界限, 政府站在輔導力場, 在有限度對自己有利的範圍內, 提供國內業者必要的協助, 實乃值得深思熟慮, 加以擬定政策, 俾資百姓有所遵循.

參. 建構社會新秩序

今年七月十五日政府宣布解嚴以來, 展開了社會蛻變的轉捩過程, 生活在這一新舊的遞嬗邊際過度的階段中, 明顯暴露不確定年代的焦慮跡象. 人人徬徨裡尋找定位, 人人與迷思漂浮作戰. 角色, 價值, 規範的不確定衝突, 明顯的表露在社會的每一個角落上. 此種社會脫序現象, 正是長久僵化製度化下, 社會反功能的集體併發症候體:

(一). 來自政府缺失的症候群: 根據執政黨一項調查報告指出, 政風敗壞貪瀆, 無力禁絕. 行政效率低落,稅負制度不合理, 公害防制乏力, 環境嚴重污染. 交通秩序混亂, 無力改善; 社會風氣敗壞, 色情賭博盛行, 取締無力. 盜竊猖獗治安惡化, 攤販管理不當, 司法威信不足, 教育措施不當, 影響學生身心成長, 消費者權益無合理保障, 違建數量增加, 阻礙現代都市發展, 制定政策缺乏與民眾溝通, 選舉不良風氣, 未有改善等等, 皆是民怨之所在, 致使民眾不滿政府之
1. 心態不正, 賞罰欠明.
2. 領導不強, 等因奉此.
3. 法制不適, 率由舊章.
4. 通識不足, 資訊落伍.

(二). 來自民間現代化, 民主化, 法治化觀念不足的症候群 -  
貧富不均加重, 富者豪宅廣廈多棟, 貧者無立錐之地, 交通紊亂, 大家樂, 飆車, 追逐暴利, 缺乏公德心, 自力救濟, 抗議請願, 走向接頭, 挑戰公權力, 心態歧異, 為反對而反對, 易被煽動風走火入魔火…等等缺乏民主素養與法治觀念造, 成刁民蠻民的不良型態, 成為政府棘手的問題之源.
此兩大症候群, 互為因果, 舊痒未復, 新症又起, 惡性循環, 導致違法亂紀, 無法無天的事件, 嚴重影響善良風俗與社會安寧, 對政府公信力, 公權力造成空前未有之挑戰. 如此陳陳相因盤根錯節的諸多問題, 未知院長是否以高瞻遠矚的胸襟與大刀闊斧的作風, 來化解民怨, 改革行政, 重新建構社會新秩序的藍圖, 向我們這個號稱有錢的要命卻無聊的發慌的矛盾體, 加以全身健康檢查. 是故就當前最重要, 而且最迫切的三項問題請教院長:

1. 我們現存的各種社會福利法是否與時並進, 匡疑補漏不露, 適時修正, 使之更落實到社會安全的目標.
2. 政府是否有加速開闢適當休閒場所, 以調劑國民身心之健康?

(三). 現代社會已跨入資訊革命的時代, 其於政治, 經濟, 工商, 教育, 社會, 文化的方面的影響無遠佛屆, 至深且巨, 對國家建設與 民眾福祉的貢獻尤大. 世界各國面臨資訊革命所代表的種種挑戰, 均積極進行辦理新傳播通訊科技及服務系統之研究發展政策, 以加強人與人之間的聯繫, 提高生產力增進社會和諧, 促進文化交流, 以提升生活素質, 但為達此目的 我們將面臨極其複雜的課題, 例如:

1. 我們應如何面對資訊革命, 使它不至於像工業革命那樣悄悄從我們身邊溜過
2. 在需要龐大資金及複雜系統設計下, 應如何充分掌握傳播通訊科技自立生根的大好機會?
3. 資訊革命需要巨額投資. 與大家厲害攸關, 我們應如何何避免面對一片空白而不踏實的言論?

為此使國家配合時代潮流因應國際局勢際, 追求資訊與時代同步, 加緊制定長期研究發展新傳播通訊科技媒體計畫, 加速視試聽資訊服務的建, 開放有線電視及汽車無線電話等, 有利國計民生的重大措施. 因為未來電信網路發展更高效率時, 其發展趨勢將使通訊電腦相結合朝向, 建立單一整合服務數據網絡的長期目標. 科技長期發展的結果, 終將引進光纖導入戶用戶, 提供整合寬頻光纖網路的視聽資訊服務, 如提供MTV視聽欣賞, 購物, 家庭守衛, 保全, 雙向教學…等等, 適應現代國民生活所需資訊, 教育, 及娛樂三方面的需要, 所以請鈞院強化資訊, 教育, 娛樂, 及社區發展服務.
是以敦促鈞院早日完成 - “拓展憲政新境界, 開創經濟新里程, 建構社會新秩序,” 的三新改革, 、落實 “國家安全, 社會安定, 人民安康”的三安施政方針.

Draft: category Two - Provisional Proposals 臨時質詢.

臨時質詢: 中華民國 76年10月20日 (Oct. 20, 1987) 

案由: 充實國會和改造國會成為本會期之重要議題.

為反應前些日子以來, 關心民主憲政千秋發展大業的學者, 專家, 各個階層名民眾之意見, 各種傳播與論紛紛出籠, 各式各樣的方案措施對策, 以求能紓解並兼顧法律法統, 及現任之 ”資深” 民代安處的三角習題, 經政府廣泛徵詢各方意見審慎研究後, 千呼萬喚 ”使” 出來, 以增加 台灣增額代表, 增設全國選區的全國代表, 取消國大代表遞補制, 維持 ”資深” 民代 運作制度 (即不制訂退休辦法) 等四項基本做法, 與求達成充實國會的預定目標, 此與一般顧及限時特殊情境政治運作之改造國會的名義之間產生相當大的鴻溝, 不但與當前政治革新的蓬勃生機, 步調不相襯, 亦與民眾要求全面改選的立場大相逕庭.

目前國會結構疲病, 功能未彰, 主體”資深”委員日漸凋零所產生的問題, 隨著民眾政治意識之高漲, 改革期待著迫切, 而漸趨不耐. 如今呈現在民眾之前的初步方案, 只是一種消極體局部修補, 執政黨依舊是畫地自限, 圖再增加名額的老方法上打轉, 突視近40年來"有效管轄區" 只限於只限於台澎金馬之事實, 對國會凋零的問題, 抱與無可奈何的消極心態. 有關對”資深” 民代之安處措施, 一概不問. 整個初步方案, 彷若新瓶裝舊酒, 不僅有違背民意, 阻礙民主憲政制發展.

此項改革初步方案, 設計, 涉及層面極為深廣. 時間雖然迫切, 但不應而粗糙, 保守, 退縮. 宜更審慎修正, 務期以合理合法公平之原則, 修訂眾望所歸之措施, 以避免不必要之政治抗爭, 並求凝聚民心, 全健全國會機能, 維持民主憲政之發展!

臨時質詢: 中華民國76年11月17日 (Nov. 17, 1987)

案由: 全國各地區之里鄰長, 雖未列入行政院人事行政局規定之服務對象, 然其深入民間, 服務桑梓, 功不可沒. 理應比照軍公教人員之部分規定, 予與里長醫療保險, 鄰長比照軍公教人員發給福利購買證, 以嘉勉長年辛勞杯, 俾使益奮其力, 貢獻基層

全國之里鄰長, 為政府之興革, 對各項行政措施之改進, 對民眾之服務等卓越績效, 可謂是革新政治風氣, 提高行政效率, 擴大民眾參與,策進政府建設之服務尖兵. 因為他們受自於地方上之擁護愛戴錯, 碩得人望, 熱心桑梓, 為鄰里所稱道信任, 而受託以重任, 以反應里鄰興革意見, 服務鄰里最迫切最具體式之需求. 在強調社區發展, 地方自治的現代社會, 里鄰長任務之重大, 服務項目之直接深入, 並不亞於一般列入行政院人事行政單位之公務人員, 有時甚而有過之而無不及! 里鄰長服務理論最基層單位, 並未列入行政院人事行政局規定之服務對象, 並不支領政府薪水之地方基層自治理服務人員, 僅有一微薄之車馬費, 報紙. 里長有公務用電話等, 象徵性或方便之酬勞. 一般里鄰長, 也一秉熱心服務精神, 不計較此象徵性之慰勞. 眾人皆知, 將地方上的事情, 讓本地方人自己去治, 則效力最高. 又為地方自治, 國之礎石. 礎不堅, 則國不固.

若里鄰長之服務領導得到更加地進肯定, 地方意見得到更充分之溝通與重視, 則地方建設必定更順利, 國家的基礎自然也就更鞏固了. 基於此理, 政府應從旁輔助, 使里鄰長之關鍵角色, 充分得以發揮, 對里鄰長之福利措施, 更不能有所疏忽. 因此, 為嘉勉里鄰長平日之辛勞, 應給予有醫療保險, 鄰長應比照軍公教人員, 發給福利品購買證, 俾使益奮其力, 貢獻桑梓, 特向行政院提出質詢.

Crystal Curriculum Vitae

Crystal LC Huang, is a writer, folksong melophile, visual art/social science educator, and "poetic" cultural-n-social critic.
